I. General

Please read these terms and conditions for the use of this web booking service (the “Terms and Conditions”) carefully before making any reservation via this website. By making a reservation through this website, you confirm that you accept these Terms and Conditions and sign a contract with Amort Sas of Benno Amort & C., tax code and VAT number 02940250216, with registered office at Via Cesare Battisti 20, 39042 Bressanone ( BZ), Italy (“ISARCUS”) These terms include the terms and conditions for accommodation services provided by ISARCUS.

All information provided by the user in relation to the use of this website, in particular but not limited to the purpose of the booking, must be truthful and accurate and can be considered as such.

The web booking service is managed by Clock Software Ltd. registered in England, with a registered office at 27 Redcliffe Gardens, London, SW109BH, United Kingdom and with company number 08008667 (“CLOCKS”). Unless otherwise specified (Article VI), nothing in these Terms and Conditions must be interpreted in such a way that CLOCKS is considered as an agent or intermediary in relation to your contract with ISARCUS, use of the web booking service or has other obligations of any kind for you or any other third party.

II. Booking and cancellation policy

Within the booking process, you can select one of the following booking options:

Best Flexible Rate

This rate offers the most flexible access to the choice of accommodation. City tax is not included in this price. Reservations can be canceled up until 2:00 pm 7 days before arrival, at no cost. Reservations canceled after 7 days before arrival or no show will be subject to 100% payment of your booking.

14 days before your arrival date, we will request the pre-authorization to charge your credit card 100% of the total amount, but only to verify its validity. At the time of check-out the pre-authorized amount will be canceled. The speed of re-credit will depend on the issuer of your credit card. (normally after 7-10 days).

Non refundable rate

This room rate offers the lowest available rate. To qualify for this rate, full prepayment is required. In case of changes or cancellations, the payment is non-refundable. If you leave early or cancel or fail to honor this reservation for any reason, you will not receive any credit or refund. Any extension of the stay will require a new booking for additional dates, subject to availability and prevailing rates, and this rate will not be applied.

All offers are subject to availability at the time of booking. The availability of the offer must be confirmed by ISARCUS.

III. Tax rates

The rates on our website are in euros. They are exempt from the tourist tax that is collected by ISARCUS on behalf of the Municipality and can be charged separately in the amounts applicable at the time of the service provided.

Rates can be changed at any time. This does not apply to bookings already made, except in cases where applicable taxes are modified by law.

Offers are not valid in combination with other offers or contracts and do not apply to groups. Rates are per room, per night, vary depending on the date of arrival and / or length of stay, and include taxes, service charges, unless otherwise specified. Early departure rates may apply.

IV. Terms of payment

Guarantee

All reservations require a guarantee or a deposit in place. Guaranteed reservations are held until 12.00 noon the day following the scheduled arrival. If a warranty or deposit has not been provided within the period specified by us, the relevant reservations may be canceled without notice and we reserve the right to reallocate the apartment or property in question without prior notice. In such circumstances, we will not be obliged to refund any deposit paid by you (or any other person in connection with the booking).

Full payment

Full payment must be made at the time of booking (pay in advance and save – non-refundable) or upon arrival (flexible rate). If you select the flexible rate and cancel the reservation after 14:00 of seven days before arrival or no show, the full amount of the booked stay will be charged.

Terms of payment

The accepted methods of guarantee include: credit card, deposit, a pre-approved travel agent or a pre-approved company. A deposit can be used as a guarantee method. The following deposit methods are accepted: bank transfer, cash and credit card. To guarantee the reservation and confirm the reservation, it is necessary to provide credit card details (or details of other accepted payment methods). In some cases (for prepayment or guarantee purposes), your credit card (or other accepted payment method) may be charged or pre-authorized.

Reimbursement

All prepaid reservations are non-refundable for any reason, unless ISARCUS agrees with you. No amount will be charged to your account in relation to cancellations until the last time you may have checked in without incurring the relevant charge described in these Terms and Conditions.

V. Access to the site

This website is available for free. Neither CLOCKS nor ISARCUS are responsible for any additional costs that may be imposed on the user by a mobile or other type of telephone service provider.

There is no guarantee that this site, or any content within it, will always be available without interruption. Access to the site is permitted on a temporary basis. The site of any of its parts may be suspended, withdrawn, interrupted without notice. Neither CLOCKS nor ISARCUS will be liable to the user if for any reason the site is not available at any time or for any period.

You are responsible for making all necessary arrangements for accessing the site. The user is also responsible for ensuring that all persons accessing the site through the Internet connection are aware of these Terms and Conditions and that they comply with these conditions.

VI. Data privacy

By using this website, you consent to ISARCUS and CLOCKS to process your personal data that you provide to the booking form.

Pursuant to articles 12, 13, 14 of the EU Regulation 2016/679 – GDPR we inform you that the personal data provided by the user will be treated in compliance with the current European and Italian harmonization legislation. VII. Intellectual property rights

CLOCKS holds all intellectual property rights in this web booking service and ISARCUS is its authorized user. ISARCUS is the sole owner, licensee and authorized user in relation to any content and material published on this site. All works (the site and its contents) are protected by copyright and processed worldwide. All these rights are reserved.

You may use this site and its content solely for personal, non-commercial and private use subject to applicable copyright laws. You may not use any part of the site without obtaining a license to do so from CLOCKS or its contents from ISARCUS or, as the case may be, from any other authorized licensor.

It is not necessary to copy, display, modify, download, reproduce or transfer to third parties any part of the content or material on this site without permission to do so.

Nothing contained on this site should be interpreted as a concession to you or anyone else of any license or right to use any trademark or other intellectual property of ISARCUS or CLOCKS (“IP”) and you may also not use any meta-tags or other hidden text that uses the IP.

VIII. Specific conditions

City Tax

City Tax of 2,40 € per adult (14 years or older) is not included in the stay price and must be paid separately at the reception.

Pet Policy

Pets are welcome in our two-room apartments. Additional cost per pet: 30 € for the entire stay. We provide dog beds and feeding bowls. It is strictly forbidden to leave pets on sofas and beds. Failure to comply with this rule will be charged an additional fee for basic cleaning in the amount of 100 €.

Extra beds

Additional beds are available for 30 Euros per night. ISARCUS is pleased to provide cots for children up to two years with our compliments.

Check-in and check-out

Rooms are available from 15:00 on the date of arrival. Please inform ISARCUS at least 24 hours in advance if it is likely that you or any member of your group will arrive after 19:00. Failure to provide such data may lead to the cancellation of the relative booking and the reassignment of the room to another customer and, in the absence of prior notice, no deposit will be reimbursed. Rooms must be vacated by 11:00 on the day of departure. Failure to depart within this period may result in additional costs being charged up to the cost of an additional night in the relevant room (s).

Special requirements

If you have or any of your group has special requests, you must notify ISARCUS at the time of booking. ISARCUS cannot guarantee that any request will be satisfied (and will not have any obligation to fulfill it, except in the cases provided for by law) until ISARCUS has confirmed that it will meet it in writing. If ISARCUS is not reasonably able to accommodate special requests, it reserves the right to cancel any reservation at the time of the request or at the moment in which ISARCUS becomes aware of any special requirements, depending on which is the latter, even if in such circumstances any deposit paid in advance will be reimbursed unless ISARCUS is entitled to retain it according to these terms.

Loss or damage of personal items

The Residence will not be liable for the loss or damage to the properties of customers or guests who have not been left in the agreed care of the ISARCUS Management.

IX. Responsibility

Neither ISARCUS nor CLOCKS provide any guarantee regarding the site and its content. You are solely responsible for its use.

Site operation

Neither the Residence nor CLOCKS will be held liable for any direct, indirect or consequential loss or damage (including, without limitation, loss of revenue, loss of goodwill, loss of reputation, loss or damage to data) arising from this site or from the use of the same, any errors, inaccuracies, omissions in the services or contents provided in any way caused.

Major force

Neither the Residence nor CLOCKS can accept any liability or pay any compensation (except to reimburse sums paid for services not yet rendered), and they will be in violation of these terms, or responsible for any non-fulfillment of any of our obligations under these , if they are unable to fulfill these obligations due to unfavorable events, actions or omissions beyond our reasonable control and not caused by us, including (but not limited to) natural disasters, acts of terrorism, civil unrest, industrial disputes or bankruptcy of utility services.

Limitations of liability

ISARCUS’s total liability to the user for any losses must not exceed the amount paid to ISARCUS in relation to the booking at the time the loss occurs. We will not be liable for (1) any loss not caused by breach of contract by the Residence, breach of legal obligations or negligence, (2) any indirect or consequential loss or (3) any loss caused by you or any member of the group. Nothing in these terms should work to limit or exclude the liability of ISARCUS for fraud or death or personal injury or any other matter that we cannot limit or exclude by law. ISARCUS reserves the right to cancel any event if it reasonably believes that it could damage its reputation and in such cases no refund will be given. You will be responsible for your and your guests’ orderly conduct and at any time will not cause ISARCUS or any applicable law to be violated or cause other ISARCUS guests to be inconvenienced. You must fully reimburse ISARCUS for any loss or damage caused to ISARCUS or any interruption to our business through your actions and omissions or those of your group members, whether by negligence or otherwise, and we reserve the right to charge your card credit or debit card for these amounts.

Linking

The site provides links to other sites; however, the inclusion of these links does not imply any endorsement of such linked site or any association with their operation. Neither ISARCUS nor CLOCKS will be responsible for the contents of the linked sites or their use.

No waiver by ISARCUS of any breach of these terms will be a waiver of any subsequent breach of it or any other provision thereof.
